Through Göring's protection, Schmitt retained - despite the attacks on him by the SS - his prestigious title as Prussian State Councilor, as well as his full chair as professor of public law at the University of Berlin.
When the deputy leader's staff considered replacing Justice Minister Gürtner with Frank at the Nuremberg party conference in September 1936, with the possibility that Schmitt could then become state secretary, the SS began to plan the overthrow of Schmitt, who was now openly describing the SS as his ideological opponent.

Schmitt completed his habilitation in 1914 with the work “The value of the state and the importance of the individual for constitutional and administrative law, international law and state theory”. After teaching at the Munich Commercial College (1920), Schmitt followed calls at short intervals to Greifswald (1921), Bonn (1921), the Berlin Commercial College (1928), Cologne (1933) and Berlin again (Friedrich Wilhelms University 1933–1945).
In 1936, SS circles accused Carl Schmitt of opportunism; Although he subsequently lost his party positions, he remained a member of the NSDAP. Thanks to the protection of Göring and Frank, he remained a Prussian State Councilor and retained his professorship at the Friedrich Wilhelm University (today: Humboldt University) in Berlin.

Carl Schmitt advocated National Socialism from 1933 and became a member of the NSDAP on May 1, 1933. The SS attacks against Schmitt were largely published in two articles in the SS weekly newspaper “The Black Corps” (on December 3rd and 10th, 1936) under the leadership of editor-in-chief Gunter d’Alquen. The SS relied on material that competing Nazi lawyers and Schmitt's former Jewish student Waldemar Gurian, who had fled into exile, had compiled.

Although Schmitt had recently tried to prove his ideological loyalty by organizing the anti-Semitic conference “Judaism in Law”, the SS intervention meant the end of his career as the Nazi regime's “crown lawyer”.
